Las Vegas Extreme DUI Defense

Individual Attention for High-BAC DUI Allegations

A reported BAC of 0.16% or higher requires a defense focused on the test, its timing, and the circumstances surrounding the arrest. At Draskovich Horvath, we provide extreme DUI defense in Las Vegas backed by more than 35 years of combined attorney experience.

We give each client personal attention and don’t treat a high-BAC allegation as a routine file. We rigorously examine the facts, consult relevant resources, and develop a defense strategy around the client’s individual circumstances.

Nevada’s 0.16% High-BAC Threshold

Nevada’s standard per se DUI threshold for an adult driver is a blood alcohol concentration of 0.08% or higher. Per se means the alcohol level itself can establish the prohibited level without separate proof that alcohol impaired the driver.

A blood or breath alcohol level of 0.16% or higher is commonly described as an extreme DUI or high-BAC DUI. Under NRS 484C.350, that level triggers an alcohol or other substance use disorder evaluation for a first-time offender. The evaluation requirement is distinct from the 0.08% threshold for a standard per se DUI allegation.

Senate Bill 309 lowered the evaluation threshold from 0.18% to 0.16%, effective October 1, 2025. References that continue to identify 0.18% as Nevada’s current high-BAC threshold are outdated.

Potential Consequences of a High-BAC DUI

A reported alcohol level is one of several facts that can affect the classification of the charge and the potential penalties.

Important consequences under current Nevada law include:

  • Required evaluation: A reported BAC of 0.16% triggers the statutory alcohol or substance use disorder evaluation requirement for a first-time offender.
  • Second offense: A second DUI within seven years carries a mandatory minimum jail term of 20 days under the law effective October 1, 2025.
  • Third offense: A third DUI within seven years is charged as a Category B felony regardless of the reported BAC.
  • Injury or death: A DUI causing substantial bodily harm or death is charged as a Category B felony and can carry prison exposure.

The outcome of an earlier case doesn’t predict what can happen in a new one. Our DUI attorneys can discuss prior case results upon request and explain how the facts and procedural posture differ.

How We Examine Blood & Breath Test Evidence

A chemical-test result shows the alcohol level when the sample was collected, which may be later than the alleged driving. That level can change during the interval. Rising BAC describes a situation in which the concentration was still increasing after driving but before the blood or breath test.

For a reported breath result, we can examine how the test was administered and review available equipment records. Those materials may provide context for assessing whether the reported number reliably reflects the test performed.

Blood testing creates a different documentary record. Sample collection, handling, and laboratory analysis records can clarify how the sample moved from collection through testing. We assess those records rather than assuming every result of 0.16% or higher presents the same issues.

The Las Vegas DUI Process After an Arrest

A DUI arrest starts two separate proceedings: a Nevada Department of Motor Vehicles administrative matter and a criminal case. Action in one proceeding doesn’t automatically resolve the other.

The Seven-Day DMV Deadline

After a Nevada DUI arrest, the driver’s license is seized and a temporary seven-day permit is issued. The driver has seven days from the arrest to request a DMV administrative hearing challenging the summary license revocation. A summary license revocation is an administrative loss of driving privileges imposed before the criminal case is resolved.

The Criminal Court Case

Las Vegas-area DUI cases begin in Las Vegas Justice Court. Felony-level DUI charges move to the Eighth Judicial District Court. Our attorneys have appeared in criminal court nearly every day throughout the last 35 years.

We handle DUI matters from early license-revocation issues through arraignment, suppression motions, negotiation, and trial when needed. An arraignment is the court appearance where the charge and plea are formally addressed. A suppression motion asks the court to exclude evidence obtained unlawfully.
