What made you choose a career in criminal law?
I’m a strong believer in the Constitution. Our Justice system is directly controlled by our Constitution. I believe our country is stronger and truer to its founding purpose when the Government is forced to follow the Constitution. Criminal defense is an area where I can see and feel I’ve made a difference in an individuals life, given them a second chance – an opportunity for a different and better result in their lives.
In your opinion, what sets your firm apart from other firms in the area?
Our firm is set apart by our pride, dedication and quality. We use a detached approach – one is where our intelligence and logic guide us in making winning choices for our clients. Tell us about a case that you are particularly proud of:
Two cases immediately came to mind. My client was charged with Robbery with use of a Deadly Weapon. After an exacting investigation and review of the discovery (police report and videos) I was able to argue to convince the district attorney that my client was not guilty, but was in fact innocent. He was wrongly arrested and charged but my effort prevented a tragedy. The second case is regarding a drug case in which my client was guilty but the results were outstanding. My client was a drug user who was facing ten (10) years in prison. He had become involved in trafficking and sales of drugs to support his drug habit. Through both litigation and negotiation I was able to get him into a drug program which upon graduation the charges were dropped and he was able to work, to school and return to his family to be the father he always wanted to be.
What steps do you take to prepare for a difficult case?
Proper preparation is key to success. First I read all of the discovery (documents associated with the case provided by the government) to understand what the state is saying happened. I speak in depth with my client to understand what really happened. As well, my office investigates the facts of the case by going into the street to ask questions and uncover potentially hidden defenses the State is unaware of or has ignored. I then pull all the information together to form a powerful defense for my client.
How do you view your role in the attorney-client relationship?
I am a guide for my client. I have the knowledge of the law and the practical experience of nineteen years of daily practice in the Southern Nevada courts. After I prepare for the case, as described above, I explain how the legal system is supposed to work, then how it works in reality. I give my client the various choices available to him. I then explain, based on the facts, how the case will likely work out. I always tell them I will execute whatever choice they make as long as it is legal and ethical. My clients make their own informed choices, which I help carry out. I don’t push people into “deals”.
What sets you apart from other criminal defense attorneys – why is this important?
Pride, dedication and professionalism. I care about the results of each case for each client. I do not make promises to my clients. I give my very best effort, to each and every client and the results show. I have a very strong positive reputation in the courts, among judges, prosecutors and the other criminal defense attorneys. How does having experience benefit your clients?
I have been practicing virtually every court day for 21 years in our Southern Nevada courts. I have over ten thousand court appearances. Active experience is a key element to the quality and results a lawyer produces. I say active experience because an attorney needs to be active and aggressive in using his experience to the benefit of his client, not sit back and say I’ve seen this before yet do nothing.
What types of cases do you specifically handle?
All criminal cases. I have especially deep knowledge and experience in drug crimes, DUI and domestic violence cases. I regularly handle drug cases in which my clients face a minimum mandatory prison term of ten (10) years to life in prison. Many of my clients are alleged to be part of DTO’s (Drug Trafficking Organizations) I also handle all drug cases including simple possession. DUI - Driving under the Influence cases take me to court on a daily basis. I successfully handle DUI cases in every state court in Southern Nevada. My client base is by direct referral because I get the results my clients need. Domestic violence, is a unique situation which needs to be handled correctly. If done poorly it can affect a client’s rights and family situation for the rest his life. If handled correctly, I put my clients in the position to get a fresh start.
In your opinion, what is the most rewarding aspect of your job?
Getting the job done right. It gives me great satisfaction when I know the case was handled correctly and the result made my client happy. I know they’re satisfied because they recommend me to their friends. That is the ultimate compliment.
What advice do you most often give your clients & why?
Once they’ve hired me I tell them to relax and live their life. They can put the pressure of their case on my shoulders and I will handle it. That is one of the key reasons my clients refer others to me. They have the confidence that I will protect them and get the best possible result for them.
